The legal framework of the ICC is characterized by some peculiarities such as, for instance, the strong reliance on State parties' cooperation (particularly for making arrests and enforcing sentences), the relationship with the UN Security Council and the complementarity to national jurisdictions. At the the same time, the ICC is the target of the political hostility of some States (i.e., the African States and the United States) that challenge prosecutorial strategies and choices. Paragraphs 2-5 focus on certain legal peculiarities of the ICC system while paragraphs 6-7 deal with US and African Union's uncooperative (if not hostile) approach with the ICC (i.e., the American Servicemembers' Protection Act, the AU Withdrawal Strategy, the International Criminal Law Section of the forthcoming African Court of Justice and Human Rights). The last paragraphs elaborates on future scenarios between ICC and the European States should the communication concerning the alleged crimes against humanity implicated in the implementation of the EU migration policies in the Central Mediterranean and Libya be received by the Prosecutor
