Le discriminazioni multiple nell’intreccio delle fonti

The essay deals critically with the issue of intersectional discrimination, tracing the scattered normative references in the various levels of law and analysing the jurisprudential rulings of the Supreme Courts. The aim of the test is to highlight whether and to what extent the multi-level regulatory framework offers an adequate definition and analysis. The analysis carried out suggests that, despite the numerous references in soft law sources, the current European and national legislative system does not specifically provide for this category of discrimination. Therefore, in an exhaustive system of discriminatory factors, in the absence of an ad hoc provision, it will be difficult for the Courts to assert a discriminatory situation which protects those situations in which multiple situations of weakness intersect and which, on the whole, aggravates the position of the person to be protected.

Il saggio affronta in chiave critica il tema delle discriminazioni intersezionali, rintracciando i riferimenti normativi sparsi nei vari livelli ordinamentali e analizzando le pronunce giurisprudenziali delle Corti superiori. L’obiettivo del saggio è quello di mettere in evidenza se e in che misura il quadro normativo multilivello offra un sufficiente apparato definitorio e rimediale. L’analisi svolta conduce a ritenere che, nonostante i numerosi riferimenti nelle fonti di soft law, allo stato attuale il sistema legislativo eurounitario e nazionale non preveda in modo specifico tale categoria di discriminazioni. Pertanto, in un sistema tassativo di fattori discriminatori, in assenza di una previsione normativa ad hoc sarà difficile per le Corti giungere ad affermare ex novo una fattispecie discriminatoria che tuteli quelle situazioni in cui si intersecano più situazioni di debolezza aggravando nel complesso la posizione del soggetto da tutelare.
