PRIME IMPRESSIONI SULLA BOZZA DI DISEGNO DI LEGGE PER L’ATTUAZIONE DEL C.D. “REGIONALISMO DIFFERENZIATO” EX ART. 116, CO. 3, COST.

after a long “pause” imposed – on the Republican Institutions – by the pandemic and, therefore, by its complex regulatory-administrative management, the Government seems now ready to resume the process of implementing the so-called “differentiated regionalism”, as crafted in par. 3 of the art. 116 of the Constitution, started between the XVII and XVIII legislatures through the signing of some “preliminary agreements” between the State and the regions of Lombardia, Veneto and Emilia-Romagna; this recovery is embodied – at the present time – by a bill drawn up by the current Government and on which, therefore, it seems appropriate to reflect analytically in the light, in particular, of some critical issues that – ictu oculi – seem to emerge from it.

dopo una lunga “pausa” imposta – alle Istituzioni repubblicane – dalla pandemia e, quindi, dalla sua complessa gestione normativo-amministrativa, il Governo sembra pronto a riprendere le fila del procedimento di attuazione del c.d. “regionalismo differenziato”, contemplato al co. 3 dell’art. 116 Cost., avviato fra la XVII e la XVIII legislatura mediante la sottoscrizione di alcuni “accordi preliminari” fra lo Stato e le regioni Lombardia, Veneto ed Emilia-Romagna; tale ripresa è incarnata – allo stato – da un disegno di legge elaborato, ap- punto, dal Governo in carica e sul quale, pertanto, pare opportuno riflettere analiticamente alla luce, in particolare, di alcune criticità che – ictu oculi – sembrano emergere dallo stesso.
