The paper analyses the matter of the regulation of lobbying in Italy, starting from the warning engraved in the sentence 185/2025 of the Italian Constitutional Court, in which is underlined – for the very first time – the necessity to introduce a sort of “general lobbying law”, aimed to define the matter regarding the representation of interests towards the Republican Institutions, especially drawing the borders of the so called “proper” – and, by difference, “improper” – influence. So, in the paper is represented the status quo of the Italian legislation regarding lobbying, even if indirectly, and are proposed some ways that might be followed to organically regulate it.
Il contributo analizza il tema della regolamentazione dell’attività di lobbying in Italia, prendendo le mosse dal monito formulato nella sentenza n. 185 del 2025 della Corte costituzionale, nella quale viene sottolineata – per la prima volta – la necessità di introdurre una sorta di «legge generale sul lobbying», volta a disciplinare organicamente la rappresentanza degli interessi presso le istituzioni della Repubblica e, in particolare, a definire i confini tra forme di influenza «lecita» e, per differenza, «illecita». Il contributo ricostruisce quindi lo stato dell’arte della legislazione italiana in materia di lobbying, anche con riguardo alle forme di regolamentazione indiretta del fenomeno, e prospetta alcune possibili direttrici per giungere a una sua disciplina organica.
